These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Jazz Games ("Company," "we," "us," or "our") governing your access to and use of the Monet mobile application and any related services (collectively, the "Service").
By creating an account, downloading, installing, or using Monet in any way, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

We reserve the right to suspend or terminate accounts that we believe have been created fraudulently, contain false information, or are used in violation of these Terms.
"User Content" means all drawings, journal entries, titles, and any other material you create, upload, or submit through the Service.
You retain full ownership of your User Content. We do not claim ownership of the drawings or journal entries you create in Monet.
By submitting User Content, you grant Jazz Games a limited, non-exclusive, royalty-free, worldwide license to store, process, and display your User Content solely for the purpose of providing the Service to you. This includes transmitting your content to third-party APIs (OpenAI, ElevenLabs) as necessary to deliver core features.
This license does not grant us the right to sell, license, or publicly display your personal content beyond what is necessary to operate the Service.
You agree not to create or submit User Content that:

Monet uses artificial intelligence (OpenAI) to analyze your drawings and journal entries and generate mood insights. ElevenLabs generates voice narration of those insights.
Important: AI-generated mood analysis is provided for personal reflection and entertainment purposes only. It is not a medical diagnosis, psychological assessment, or substitute for professional mental health advice. Do not rely on AI mood analysis for medical or mental health decisions.
You acknowledge that:
The Monet application, including its design, user interface, graphics, logo (the bird mascot), code, features, and all content created by us, is owned by Jazz Games and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for its intended personal, non-commercial purpose.
You may not copy, modify, distribute, sell, or create derivative works from our intellectual property without our prior written consent.
If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.
Monet may offer both free and premium (paid) features. Premium features may be available through a subscription or one-time purchase processed through Apple App Store or Google Play Store.
Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Payment is processed by Apple or Google via their respective platforms. We do not directly process or store payment card information.
You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods, except as required by applicable law or App Store/Google Play refund policies.
We reserve the right to change subscription prices. We will provide at least 30 days' notice before any price increase takes effect, and changes will only apply to renewals after notice is given.
If we offer a free trial, you will be charged the subscription price after the trial ends unless you cancel before the trial period expires.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
We do not warrant that the Service will meet your specific requirements or that defects will be corrected. Some jurisdictions do not allow exclusion of implied warranties, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Jazz Games AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) $50 USD or (b) the amount you paid to us in the 12 months preceding the claim.
Some jurisdictions do not allow limitations on liability for certain types of damages, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless Jazz Games and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

We are not responsible for the availability, accuracy, or conduct of third-party services. Links to third-party websites or services do not constitute our endorsement.

You may stop using the Service at any time and delete your account through the in-app settings or by contacting us at support@jazzgames.net.
We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we believe:
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) shall survive.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Jazz Games is established, without regard to its conflict of law provisions.
Before filing any formal legal claim, we encourage you to contact us at hello@jazzgames.net to attempt to resolve the dispute informally. We will try to respond and resolve issues within 30 days.
If we cannot resolve a dispute informally, any legal claim arising from these Terms shall be subject to the exclusive jurisdiction of the courts in the location of Jazz Games's principal place of business, unless otherwise required by applicable consumer protection law in your jurisdiction.
To the extent permitted by applicable law, you agree to resolve disputes with us on an individual basis only, and not as a plaintiff or class member in any purported class or representative action.
